Our firm represented a lady who was seriously injured in an automobile accident, whereby she was a passenger in a vehicle that was rear-ended by an 18-wheeler. Our client sustained multiple fractures, internal injuries, and a permanent eye injury. There were other individuals who were hurt in this accident as well, and we were dealing with limited insurance policy limits. We utilized the services of an ophthalmologist and orthopaedic surgeon who evaluated our client for permanent disability. A lawsuit was filed, and the case was mediated, and a settlement was reached for $850,000.00.
Case # 7
The firm represented a forty-six year old male forklift operator who was injured while on the job when he was knocked off a railcar while loading it. The fall crushed both of the client's ankles. The firm hired three medical experts to show that as a result of the client's injuries, he would have physical limitations in working as a forklift operator and carrying out his activities of daily living. Additionally, the firm hired a vocational expert to show how the client's injuries and limitations placed on the client prevented him from working any job in the local labor market. The defendants hired a vocational expert who opined that client could work doing a sedentary job. The firm prepared the case for trial in Shelby County, and after hearing testimony, the Judge awarded judgment in favor of client, finding client totally and permanently disabled and awarded workers' compensation benefits until client reaches the age of sixty-seven and medical benefits for life for his injuries. The judgment was in excess of $550,000.00. The court awarded client the maximum benefits he was entitled to under the Tennessee Workers' Compensation Laws.
Case # 8
A middle aged gentleman with a history of obesity and breathing problems was rehabilitating at a nursing home. The patient had a tracheostomy tube, which aided his breathing. This was inserted prior to entering the nursing home.
The nursing home staff failed to properly clean or regulate the patient’s tracheostomy tube. As a result, the tracheostomy tube became blocked with his own mucous. He went into cardiac arrest and was rushed to the hospital. The patient survived the incident, but had severe brain damage. He died six (6) months later due to a variety of complications.
The firm litigated and developed the case by retaining a nursing home expert and a respiratory therapist expert. We also did some investigative research into the Defendant’s financial background and employees. Finally, we aggressively deposed former and current nursing home staff members. The firm was able to take this case to mediation and resolve the matter for a confidential amount.
Case # 9
Our firm represented a gentleman in both an automobile accident case and a workers' compensation claim, all resulting from the same accident. While in the scope of his employment, our client was driving his vehicle when the Defendant negligently made a left turn in front of him, thereby causing the accident. Our client sustained injuries, including two (2) broken legs, a broken tail bone, chipped teeth, and some scarring. We were able to immediately obtain compensation for our client in the form of temporary total disability payments while he was off of work. This allowed our client to pay his bills. After our client was released, we settled his workers' compensation claim, with open medicals to be paid by his employer for life. Our firm represented a lady who was seriously injured in an automobile accident wherein another driver ran a red light and hit her on the driver’s side of the vehicle she was driving. Our client sustained injuries including multiple left rib fractures, a left pulmonary contusion, a left hemothorax, bilateral inferior/superior rami fractures, L1-5 transverse process fractures, a zone 2 sacral fracture and internal bleeding. As a result of the accident, she had restrictions pertaining to her ability to walk, stand, stoop, squat, bend, climb, and flexion, extension or rotation of the left hip or left knee. Case # 11
A middle aged paraplegic woman was rehabilitating her shoulder after rotator cuff surgery at a nursing home. While at the nursing home, the patient was negligently left in a bathroom by the nursing home staff for over an hour. No one checked on her or heard her as she screamed for help. In desperation, the patient tried to get out of the bathroom. She fell and ended up completely tearing the same rotator cuff which had been repaired in the surgery.
The firm litigated and developed this case by retaining a nursing expert on the standard of care in the nursing home. We also investigated the surgery and obtained the surgeon’s opinion on the cause of the complete rotator cuff tear and the patient’s possibility of recovery if this incident had not happened. Furthermore, we aggressively deposed current nursing home staff members. The firm was able to take this case to mediation and resolved the matter for a confidential amount.
Case # 12
The firm represented a thirty-four year old female who was involved in an automobile accident whereby another driver lost control of his automobile and struck our client's vehicle. Our client sustained a right ankle fracture and was not able to work for an extended period of time. In addition, she had restrictions pertaining to her ability to squat, lunge, and walk. Further, our client had to have surgery for her ankle and our firm utilized the services of an orthopaedic surgeon who determined that our client had a 20% impairment to the lower extremity as a result of the right ankle. In addition, the physician assigned her an additional 12% to the lower extremity for the injury to the right knee. The case resolved with the defendant's liability insurance company and with our client's uninsured motorist carrier for a total settlement of $225,000.00.

The firm represented a sixty-four year old male who was involved in an automobile accident with a company truck, whereby the company vehicle negligently disregarded a stop sign striking our client's automobile. Our client sustained lung contusion, fractured ribs and effusion to the left lung. Further, our client received a grade 1 spleen laceration. The case was litigated and after extensive discovery, the case was mediated with a settlement in the amount of $220,000.00.

The firm represented a twenty-three year old male who was involved in an automobile accident with another vehicle which had pulled directly in front of our client's automobile. As a result of the accident, our client sustained a right femur fracture which required surgical intervention and also had a grade 2 spleen laceration. The firm utilized the services of an orthopaedic surgeon who evaluated the client for an impairment rating and provided the client with a 25% impairment rating to the lower extremity. In addition, in light of the fact the client lost his position as a clerk and had severe restrictions the firm utilized the services of a vocational expert to determine the vocational loss of earning capacity. The case was litigated and mediated for $200,000.00.
Case # 15
The firm represented a forty-two year old male who was a passenger in a vehicle which was struck by another vehicle which had crossed the middle lane while driving on the highway. Our client sustained a ruptured C5 disc which required surgical intervention. The firm utilized the services of an orthopaedic surgeon for an impairment rating, and we also retained the services of a vocational expert to determine the vocational loss of the client. According to the vocational expert, our client was not able to return to work as a landscape laborer and as a result had a significant lost wage. The case was settled for $190,000.00.

The firm represented a thirty-four year old female who was involved in an automobile accident caused by a municipal vehicle. As a result of the accident, our client sustained a broken right knee, broken ankle which required surgery. The firm utilized the services of an orthopaedic surgeon who evaluated the client for an impairment rating based on the AMA guidelines. According to the orthopaedic surgeon, our client had a 24% impairment rating to the lower extremity. The case was resolved for $190,000.00.
Case # 17
The firm represented a twenty-seven year old female who was involved in an accident in which a defendant ran a red light and struck our client's automobile. Our client was hospitalized for four days for a fracture to her right humerus which required surgery. Our client received an impairment rating of 5% to the upper extremity and as a result of the injury she was not able to work for over one month. The firm was able to resolve the case for $150,000.00.
Case # 18
The firm represented a thirty-seven year old man who was involved in an automobile accident with another driver who fled the scene of the accident. Our client was driving a company vehicle and we were able to pursue our client's claim under the uninsured motorist policy of his company. Our client sustained an L-1 compressed fracture and our firm had our client evaluated by an orthopaedic surgeon, who determined that our client had a 20% impairment to the body as a whole as a result of the accident. During discovery litigation, it was determined that our client had been involved in a previous automobile accident in which he had been diagnosed with having a compressed fracture. The firm utilized the services of a physiatrist to delineate the differences between the previous injury and the present injury. The case was settled for $150,000.00.
Case # 19
The firm represented a thirty-eight year old male who was involved in an automobile accident, whereby an employee of a company negligently made a left-hand turn in front of our client's automobile. As a result of the accident, our client sustained a cervical ruptured disc which required surgery. The case was litigated and mediated and resolved for $130,000.00.
Case # 20
The firm represented a forty-two year old male who worked in a warehouse. Our client, while pulling boxes in the warehouse, fell backwards and as a result suffered a ruptured disc at the L4-L5 level which required fusion surgery. Our client had received a 20% impairment rating by the treating physician based upon the Fifth Edition of the American Medical Association Guidelines. A change in his position affected his seniority, and the employer relegated him to performing only perfunctory office work. Our firm took the position that our client had not made a meaningful return to work since his employer had never put him back in the warehouse for the job which he had been hired. Our firm was able to convince the insurance company to make the temporary benefit payments and make a settlement for 60% to the body as a whole in the amount of $125,848.80 with open medicals. Our client received $45,169.76 at the time of the settlement and the remainder was paid out over a seven year period.
Case # 21
The firm represented a twenty-year old lady who was sitting at a table in a restaurant when a waiter carrying a tray slipped on some water and dropped the tray on the client's neck. As a result of the accident the client sustained a cervical disc injury. As a result of the injury, disc surgery was performed for the client's cervical disc injury. The case was litigated and resolved for $125,000.00.

The firm represented a thirty-three year old woman who was involved in an automobile accident case where she was struck by a concrete truck. Our client sustained injuries to her back, neck, stomach and right leg and was transported to the hospital. Our client received physical therapy and according to the orthopaedic surgeon who evaluated the client she sustained an 8% impairment rating to the body as a whole as a result of the accident. The firm represented a seventeen year old minor who was a passenger in a school bus that was involved in an automobile accident. The client sustained a broken right hip, dislocation of her right knee and bruising of her lungs. The case was litigated and after mediation the case was resolved for $108,000.00. The medical bills and lien interest were significantly reduced and the court approved the minor settlement.

The firm represented a twenty-two year old male who was involved in a one car automobile accident in Olive Branch Mississippi. The client was a passenger in an automobile in which the driver negligently ran across a road hitting a mailbox. As a result of the accident our client had a broken femur which required surgery and received a 10% impairment to the lower extremities due to the severity of his injuries. Also, our client had serious restrictions in that he was not able to perform daily activities including cooking, walking, hunting and fishing for a considerable period of time. The firm represented a fifty-five year old male who was a passenger in an automobile which was traveling through an intersection with a green light in Ripley Tennessee and struck by a defendant who ran a red light. Our client sustained a fractured left hand which required surgery. Our firm was able to negotiate a settlement of $100,000.00 which included $25,000.00 from the liability carrier and an additional $75,000.00 from the uninsured motorist carrier of the host driver.

The firm represented a forty-five year old lady who was rear ended at a traffic light. As a result of the accident our client suffered a herniated disc which required surgery and was assigned and 18% impairment rating by the evaluating orthopaedic surgeon. The firm was able to negotiate a settlement in the amount of $100,000.00 which represented the defendant's policy limit.

The firm represented a forty year old female driver who was struck by another car who was making an improper left-hand turn in front of our client. As a result of the accident, our client sustained a broken ankle which required surgery. The client's medical bills were $18,317.64. The case was litigated and was resolved for the $100,000.00 insurance policy limit. Also, our office was able to successfully reduce the lien of the insurance subrogation holder to $6,745.39.
Case # 28
The firm represented a thirty-one year old male who was a passenger in an automobile in Tunica Mississippi. The driver of the automobile hydroplaned and ran off into an embankment causing our client to sustain a fracture of the arm and a dislocated elbow. Case was resolved for $100,000.00 which represented defendant's insurance policy limit and the firm was able to obtain reduction from Mississippi Medicaid.

The firm represented a minor twelve year old child who was a passenger in an automobile accident which had been rear-ended. The child had sustained multiple injuries, including but not limited to a left leg fracture, alveolar ridge factor, which resulted in the removal of teeth. The medical bills were paid by health insurance and the firm was able to negotiate a complete waiver of subrogation claim by the insurance company. After litigating the case, the case was resolved for the defendant's insurance policy limit of $100,000.00, which was paid out in the following order: one lump sum payment of $30,000.00 upon the child's eighteenth birthday to yearly payments made to the child at the rate of $14,840.00 per year beginning on his eighteenth birthday and continuing until he reaches the age of twenty-two totaling $59,360.00.
Case # 30
The firm represented a sixty-one year old female driver who was rear-ended by an individual. As a result of the accident our client sustained a broken left arm and incurred medical bills in the range of $38,000.00 and was diagnosed with fracture of the fourth metatarcial bone and a fracture of the left distill end of the radius. She required surgical intervention and was not able to walk for an extended period of time. The firm was able to resolve her case for the policy limit of $100,000.00 and was able to reduce the subrogation interest of all of the providers to approximately $15,000.00.

The firm represented a fifty-four year old construction project manager who was struck by a vehicle while inside the construction zone. As a result of the accident, our client sustained a ruptured cervical disc which required a cervical disectomy and fusion at the C6-C7. We represented our client concerning 2 cases, a workers' compensation claim against the employer, and a third party claim against the negligent driver. The firm represented the client in the workers' compensation case and was able to obtain temporary benefits while the client was off work. The firm represented a thirty-seven year old male who was a passenger in a vehicle which struck a curb and a utility pole causing our client to be ejected from the automobile. Our client sustained a right tibia fracture, left clavicle fracture, bilateral pulmonary contusion and seven fractured ribs. As a result of the injury our client had several surgeries. Further, he was unable to work for several months. The firm was able to negotiate a resolution for the defendant's insurance policy limit of $100,000.00 and was able to substantially reduce the health insurance subrogation interest in order to effectuate the settlement.

The firm represented a fifty-two year old lady who was rear-ended by a company truck. In an effort to deny liability, the defendant claimed that he was stung by a bee causing him to rear-end our client's automobile. Our client incurred $18,422.00 in medical bills and suffered gastro intestinal bleeding and was also treated by an orthopaedic doctor for muscle spasms and contusion. The case was resolved for $86,000.00 and the liens of the hospital and the insurance company who sought reimbursement were reduced to $7,315.46.
Case # 36
The firm represented a seventeen year old, who was a passenger in a vehicle which was negligently driven by the defendant. Our client sustained loss of consciousness and suffered an ankle fracture. Our firm referred our client for an evaluation by an orthopaedic surgeon who provided her with a 7% impairment to the right lower extremity.
